Terms of Service

1. Platform Overview

Vybrants is an online marketplace that enables creators to upload, host, and sell video-based educational courses. Users may purchase and access these courses for personal, non-commercial use.

2. Eligibility & Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials and all activities conducted under your account.

3. Creator Content & Ownership

Creators retain full ownership of their course content. By uploading content, creators grant Vybrants a non-exclusive, worldwide, royalty-free license to host, stream, reproduce, market, and sell the content solely for operating and promoting the platform.

4. AI-Generated Content

Creators must clearly disclose if course content is fully or partially generated using artificial intelligence tools. Creators are responsible for ensuring AI-generated content does not infringe third-party rights and complies with applicable laws. We reserve the right to remove undisclosed or misleading AI-generated content.

5. Payments, Fees & Creator Payouts

Courses are sold through third-party payment providers.

• Creators receive 80% of net revenue from course sales
• Vybrants retains 20% as a platform service fee
• Net revenue excludes payment processing fees, taxes, refunds, chargebacks, and failed payments
• We reserve the right to withhold or delay payouts where fraud, abuse, policy violations, or legal compliance checks are suspected
• Payout schedules, thresholds, and supported payout methods may change with notice

Creators are solely responsible for reporting and paying applicable taxes in their jurisdiction.

6. Refunds & Cancellations

Due to the digital nature of the content, purchases are generally non-refundable unless required by law or otherwise stated.

• EU consumers may be required to explicitly waive their 14-day digital content withdrawal right at checkout.
• Refunds may be issued at our discretion in cases of technical failure or misleading content.

7. Prohibited Content

Content may not:

• Infringe intellectual property rights
• Be misleading, deceptive, or unlawful
• Contain hate speech, harassment, or explicit harm

8. Account Suspension & Termination

We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or terminate any account or access to the platform if we reasonably believe that a user or creator has:

• Violated these Terms, our policies, or applicable laws
• Uploaded infringing, misleading, or harmful content
• Engaged in fraud, abuse, or attempted circumvention of platform systems
• Created risk, legal exposure, or reputational harm to the platform or its users

We are not liable for any loss of data, revenue, or access resulting from account suspension or termination.

9. Disclaimers & Limitation of Liability

The platform is provided on an "as is" and "as available" basis. We make no warranties regarding uninterrupted access, availability, accuracy, or reliability of content.

To the fullest extent permitted by law:

• We are not responsible for creator content, including accuracy, legality, or outcomes from consuming courses
• We are not liable for lost profits, revenue, data, or business opportunities
• Our total liability shall not exceed the total fees paid to us by the user in the preceding 12 months

To the fullest extent permitted by law, Vybrants shall not be liable for indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vybrants, its founders, directors, employees, and partners from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:

• Your use of the platform
• Your content or courses
• Your violation of these Terms or applicable laws
• Any dispute between you and another user

11. Governing Law

• Singapore users: Laws of Singapore
• US users: Laws of the State of Delaware, USA
• EU users: Laws of the user's country of residence

12. Community Guidelines

We expect all users and creators to:

• Act respectfully and professionally
• Share accurate and original content
• Avoid deceptive marketing or false claims

Violations may result in content removal or account suspension.
